General Terms & Conditions

1 - GENERAL 

1.1 These terms and conditions and the accompanying privacy policy ("Agreement") set out the basis on which customers ("you" or "traveler(s)") agree to and accept the services provided by Pyrenees & More ("we" or "us").

 

1.2 The General Conditions described herein are in accordance with current legislation, being subject to the provisions of Royal Legislative Decree 1/2007 which merges into a single text the General Law for the Protection of Consumers and Users. 

 

1.3 These General Conditions apply to all events organized by Mountain and More S.L.. and together with the Specific Conditions described in the detailed program of each event and act as the final contract. All aspects not reflected in these general conditions shall be governed by current legislation.

 

1.4 If you are travelling with other people, you agree to make all such people aware of these terms and conditions and privacy policy.

1.5 We may amend our terms and conditions at any time without notice. It is therefore important that you read these always before confirmation of your trip, even if you have used our services in the past. The most recent version of our terms and conditions can be found on this page. Should they change after your confirmation, the ones in place at the time of your confirmation will apply for your trip. 

 

 

2 - ORGANIZATION

2.1 The organization of events (package tours/trips and outdoor adventure/cultural activities) that are subject to these conditions is carried out by Mountain and More S.L.. with travel agency license CICMA 4228 and CIF B05400569 and whose registered office is C/ Matalavieja, nº 1, block C, 28470 Cercedilla, Madrid (Spain). Mountain and More SL meets the legal, financial and insurance requirements established by Spanish law and travel agency regulations.

 

2.2 Mountain and More S.L. operates commercially as a travel agency under its registered trademark PYRENEES & MORE. In these terms and conditions, "Pyrenees & More" refers to Mountain and More SL.

 

 

3 - ACCEPTANCE OF GENERAL AND SPECIFIC CONDITIONS

3.1 The booking of any event implies the acceptance of these General Conditions as well as any Specific conditions applying to that event. Additionally, at the time of booking, the customer must expressly accept these Terms and Conditions by checking the option "I have read and accept the General Conditions of Pyrenees & More." that appears on the reservation form. 

 

3.2 An Agreement shall enter into force at the moment when we receive (i) any deposit or (ii), in the case of a late booking, at the moment we receive full payment for the event. In any case, your use of our services also constitutes confirmation that you have read and accepted these terms and conditions.

 

 

4 - INTERMEDIARY RELATIONSHIP 

4.1 We act only as the intermediary of all suppliers of accommodation, transport, tour guides, tour providers, attractions and activities and not as principal. These suppliers are independent. You acknowledge and agree that we are not responsible for any loss, damage, delay, inconvenience or injury to you as a result of any act or omission of these suppliers, their employees, agents or representatives.

 

4.2 While we use all reasonable efforts to choose quality suppliers and carry out regular inspection visits to ensure quality standards are maintained, no undertaking, guarantee or warranty is given or shall be implied as to the fitness or condition of any goods or services provided by the supplier including accommodation, activities, transportation, food or drink. The services provided by these suppliers are subject to the laws of the place where the services are provided, and any conditions imposed by those suppliers. You acknowledge and understand that we have no liability for the actual provision of the arrangements or services provided by these suppliers. You also understand and acknowledge that the liability of such suppliers may be limited by their terms and conditions, tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements.

 

4.3 Supplier pricing and availability may change without notice. You agree that we are not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor are we responsible for any errors or omissions that may occur as a result of incorrect information from third parties.

 

 

5 - PRICES

The services included in the final price of the event are indicated in the detailed quotation provided to the client for the event. We do not provide an itemized cost of the elements of your event. All our prices include our management fees and VAT (value added tax). Pyrenees & More prices are quoted in Euros. 

 

As a general rule, and unless otherwise indicated in the detailed quote, the final price of the event does not include:

- Transportation necessary to get to and from the start and end points of the event respectively.

- Visas

- Vaccination certificates if necessary.

- Entrance fees to monuments, national parks, etc. that are not included in the detailed price proposal of the event.

- Rental of specific material required for the realization of any technical activities during the event.

- Rescue in case of accident and any additional expenses that this could generate (see sections 11 and 12 of these General Conditions).

- Extras such as coffees, wines, liquors, mineral waters, special diets, not even in the case of full board or half board.

- Optional hotel services.

- Gratuities.

 

Independent services provided by third parties that Pyrenees & More may suggest as optional in the detailed program of an event, such as transportation, excursions or visits, are not included in the original contract. The publication of these suggestions in the communications with the client is for information purposes only and prices are estimates, Pyrenees & More is not responsible for any possible variations.

 

 

6 - RESERVATION/BOOKING AND PAYMENT 

6.1. Reservation form

When you notify us of your intention to book an event, we will send you a booking reference number and a reservation form.

 

Each participant will be required to complete this form, which will provide us with your personal information and other relevant details necessary to initiate the booking process. On this form you will also indicate your preferred method of payment, either by credit card or by bank transfer.

 

Upon receipt of the booking form, Pyrenees & More will send you an invoice detailing the amounts due for deposit and balance (if applicable) and instruct you on how to make payment of the deposit, or full payment, if applicable (see 5.2 below).

 

6.2 Deposit

A deposit per person of 500 euros or an amount equal to 30% of the estimated total event cost - whichever is greater -  is required to reserve a place on a given event; the outstanding balance is due 60 days prior to the tour start date. The exact date for payment of the balance will be indicated on the invoice. Reservations made less than 60 days prior to the tour start date must be paid in full.

 

6.3 Payment

Payments can be made by credit card or electronic bank transfer to our account in Spain as described on the invoice. If you choose to pay by credit card, we will send you a link for secure payment via STRIPE.

 

In case of payment by bank transfer, you will be required to pay additional fees to ensure that Pyrenees & More receives the full amount due.  Please refer to your travel invoice for the exact amount due.

 

6.4 Confirmation

We will only be able to confirm your booking once we have received both the deposit (or full payment if applicable) and the booking form from each participant. At that time, we will send you a payment receipt detailing the amount paid. 

The contract will come into force between you and us on receipt of the relevant deposit or, in the case of a late booking, on payment in full of the event fee.

 

6.5 Waiver of Liability

We will send you a Waiver and Assumption of Risk (Waiver of Liability) form, which you must sign and return to us in order to complete your booking.

 

6.6 Proof of Insurance - We require proof of insurance in order to participate in our trips. See more details in section 6 "Insurance" of these conditions.

 

 

7 - CANCELLATION AND REFUNDS 

7.1 Cancellation by you.

Any cancellation must be notified to us in writing, and will only be effective upon receipt by us. We will refund any amount you have already paid, less any applicable cancellation fees, which are based on the time we receive your notice of cancellation. All cancellations and "no-shows" are subject to the following non-refundable cancellation fees:

 

(i) more than 30 calendar days prior to the event start date stated on the invoice, the cancellation fees will be the Deposit;

(ii) 15 to 30 calendar days prior to the event start date stated on the invoice, 50% of the total cost of the trip;

(iii) 14 calendar days or less prior to the event start date stated on the invoice, 100% of the total trip cost.

 

No refund will be made for late arrival, early departure or unused portion of the trip.

Depending on the reasons for your cancellation, you should be able to claim these cancellation fees from your insurance company if you have taken out travel insurance. In other words, Pyrenees & More will retain the amount of the cancellation fees indicated above and transfer the remainder to a bank account of your choice, after subtracting from such remainder all applicable bank transfer fees.

 

An exception will be made in case of cancellation 45 days or more prior to departure. This is the case where we quote you an "estimated price" for the trip and then ask for payment of the deposit to proceed with the reservation.  Then, in the process of booking your rooms, due to availability issues on your preferred dates, despite our best efforts, we are forced to use more expensive accommodations or accommodations that require additional transfers, etc. If the result of this situation is that the final price of the trip is 10% or more than initially budgeted, you will have the option to cancel, with only a partial loss of the deposit, equal to 150 euros per person. In other words, only in this case, we will refund the deposit minus 150 euros per person, minus any applicable bank or credit card fees.

 

7.2 Cancellation by some members of a group

In case of cancellation by some but not all members of the group, the cancellation fees indicated in section 6.2 will be applied to the cancelling customers. In this case, if the price of the event was based on a certain number of people and the cancellation by some members causes the cost of the trip per person to increase, Pyrenees and More will communicate the modified price to you. You will have the option to accept the new trip price or cancel with forfeiture of your deposit only.

 

7.3 Cancellation by us. 

Pyrenees & More reserves the right to cancel a trip at any time for any reason prior to departure and in such event will refund in full any payment of the trip price made by the participant.

 

Pyrenees & More is not responsible for penalties incurred due to the purchase of non-refundable airline tickets.

 

 

8 - ALTERATIONS AND MODIFICATIONS

8.1 If you wish to change your booking (date changes, postponements and other alterations to the program made by you).

 

If, after you have made any payment, and up to 30 days or more before the scheduled start date of your trip, you wish to change or alter your existing booking (e.g. change the dates (postponement), change the itinerary, change to a different trip or change the accommodation or tailor-made activities, etc.), we will do our best to accommodate your request; however, we will do our best to accommodate your request. ), we will do our best to accommodate your request; however, you will be responsible for any additional costs incurred as a result (e.g., higher hotel rates or higher fees for services from other suppliers).

In addition, we charge an administrative fee of EUR 25 per night per reservation (not per person) for modifying your reservation (e.g., if a 10-night trip reservation is to be modified, the fee will be EUR 250, but if only 1 night is modified, the fee will be EUR 25). 

Within 30 days prior to departure, our cancellation fees in section 5.1 shall apply to such trip modifications.

 

8.2 If you decide to amend your trip in any way once it has commenced, we will not accept any liability for loss, damage or additional expenses and will not be able to refund any expenses you have already paid.

 

8.3 If Pyrenees & More makes changes to your booking. 

Although we will always try to avoid making changes to your trip, sometimes we may have to do so. If it is necessary to change any aspect of your booking, we will do our best to notify you as soon as possible.

 

Pyrenees & More reserves the right to make changes to itineraries, the order and content of activities due to local conditions, weather or other reasons. 

 

Pyrenees & More reserves the right to modify scheduled or advertised accommodations due to local circumstances - in this case, we will make all reasonable efforts to substitute accommodations of comparable quality, as determined by us. In the event that we can only find substitute accommodations of a significantly lower standard of quality, at our discretion, we will refund monies equivalent to the differences in room rates between the original and substitute accommodations.

 

Without prejudice to Section 10 of these terms and conditions, if a proposed change is not acceptable to you, you may cancel the specific part of your booking relating to the change. In such a case, we will refund you in full for that specific part of the booking, which will constitute full and final settlement. No further refund or compensation will be made.

 

8.4 In exceptional circumstances we may be forced by “force majeure” (see section 9) to change or cancel your trip. This is extremely unlikely but if this situation does occur, we will unfortunately not be able to make any refunds, pay you any compensation or meet any costs or expenses you incur as a result.

 

 

9 - FORCE MAJEURE

Except where otherwise stated in these terms and conditions, neither we nor our suppliers are liable for any loss, damage, compensation, cancellation or expense you may suffer or incur if we are unable to perform our contractual obligations as a result of any event of ‘force majeure’. In these terms and conditions ‘force majeure’ means any event which we or our supplier could not, even with all due care, foresee or avoid. Such events include but are not limited to: war or threat of war, civil strife, terrorist activity, industrial dispute, strikes, natural or man-made disaster, fire, adverse weather conditions, epidemic or pandemic, closures of borders, seaports and airports, or any other similar events beyond our or our suppliers’ control.

If you or your clients are unable to travel due to a force majeure situation, then we would NOT apply our standard cancellation terms as per section 7 of this Agreement, but rather provide credit* for a rescheduled trip.

*Credit would not include any costs for non-refundable items on the trip, which may include domestic flights, high-speed train tickets, pre-purchased admission tickets for monuments, and others, and these amounts would be deducted from he credit offered.

 

10 - LIABILITY 

10.1 To be eligible to take a trip with Madrid & Beyond, you accept the risks of travel. Subject to the rest of this section 8 you assume full responsibility for any loss, injury, death or damage to you or to your family, or their dependents, or property arising in connection with you and their participation in the trip.

 

10.2 The costs of our trips are based on travelers agreeing to these terms and conditions. As we are acting solely as an intermediary, you release us and our employees, agents and suppliers from all liability for economic loss and physical or mental injury, illness, direct or indirect, arising in connection with the trip, including, without limitation: permanent disability and death; any emotional distress; any loss of services, financial support, aid, consortium or companionship; and any damage to or loss of property—in each case even if caused in whole or in part by the conduct, including our negligence, except where such loss, injury or damage is caused by reckless or fraudulent conduct on our part. Please note, it is your responsibility to show that we or our supplier(s) have been negligent if you wish to make a claim against us.

 

10.3 Please note that we do not accept liability for:

(i) events outside our reasonable control.

(ii) acts or omissions of suppliers and third-party service providers (see section 2.2).

(iii) any loss, damage, compensation or expense if there has been no default or neglect by us.

(iv) any special, indirect or consequential loss, including loss of profit or business loss (direct or indirect).

(v) any damage, loss, compensation or expense which you have suffered or incurred where, on the basis of the information you gave to us, we could not have foreseen you would suffer or incur.

(vi) any services which do not form part of our Agreement; for example, any additional services or facilities which your supplier or hotel agrees to provide for you.

(vii) any damage, loss, compensation or expense which did not result from any breach of Agreement or other fault we or our employees caused.

 

10.4 If we are liable to you, we limit the maximum amount we may have to pay you for any claims you may make against us. This maximum amount is limited to the full cost of your trip. 

 

10.5 You agree that you are responsible for all losses, damages or claims that arise in connection with the trip as a result of any misconduct of you or any members of your party. If any claims are made against us as a result of your acts or omissions, or those of any members of your party, you shall hold us harmless and if any money is claimed against us, indemnify us for such sums including any penalty or interest.

 

10.6 This section 8 does not apply to death or personal injury resulting from our negligence.

 

 

11 - YOUR RESPONSIBILITIES

11.1 We are committed to making your trip as rewarding and fun as possible. But we require your help to do so. We ask that you respond to our questions in a timely manner so as not to delay the planning process in creating a tailor-made trip for you.

 

11.2 It is your responsibility to ensure that you have a valid passport and/or visa (if applicable) and that you meet all necessary entry requirements of the country or countries you will be visiting, as well as those for your return home. These requirements vary by country and nationality and may change from time to time. Whilst we will do our best to keep travelers informed about entry regulations, we ask that you contact the appropriate embassy(ies)/consulate(s) in your country of residence, as well as your airlines, for official confirmation of these.

 

11.3 It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and it is your responsibility to safeguard these at all times. Subject to section 7 (force majeure), we are not responsible for any loss, theft or damage to your travel documents unless they are in our care.

 

11.4 It is your responsibility to purchase travel insurance. We strongly recommend that you purchase comprehensive travel insurance that is suited to your trip and that all your party members have such insurance in place prior to the commencement of your trip. In particular, we require that you have accident insurance covering the adventure activities on your trip. (see section 12 below).

 

11.5 We are not responsible for delays, changes or costs of any kind due to incomplete, expired or inaccurate travel documentation or insurance.

 

11.6 It is your responsibility to ensure that you and all members of your party do not behave in a way which is inappropriate or causes danger, distress, offence or damage to others or to property belonging to others. If, in our reasonable opinion or that of our suppliers, your behaviour is inappropriate and may cause any of these situations to occur we may take appropriate action, including cancelling your trip arrangements. In such a case you will not be eligible for any refunds, payments of compensation and/or any reimbursement of any cost or expenses you may incur as a result of such cancellation. You shall also be liable to reimburse us for any expenses we incur necessarily as a result of such cancellation.

 

12 - INSURANCE

We recommend you purchase travel insurance to cover trip cancellation, theft, loss of baggage etc. during your trip as well as medical expenses should you have a medical emergency (not necessarily as a result of an accident during your physical adventure activity).

 

We REQUIRE that you have an appropriate insurance policy to cover accidents during the adventure activity or activities to be carried out during the event which he/she reserves. If the client does not have such insurance, he/she can purchase it through Pyrenees & More. This insurance includes eventualities such as evacuation in case of accident, medical expenses, etc. (see the particular conditions of the insurance). 

 

 

13 - HEALTH

By sending us the Deposit (or in the case of Late Bookings, sending us the full payment), you confirm to us that neither you, nor to your knowledge anyone travelling with you, if applicable, has any condition or disability, physical or other, that would make travelling unsafe for you or other travelers. You should take up-to-date health advice about the health precautions you will need to take prior to the commencement of your trip.

 

14 - COMPLAINTS

We do not expect any dissatisfied customers, but in the event that you are not entirely satisfied with the service we provided, you should report any complaint to our office as soon as possible by calling us on +34 620 939 116 or +34 629 254 534 (8 am - 6 pm Monday to Friday) or by sending an email with details of your complaint to info@pyreneesandmore.com. We will use all reasonable efforts to rectify the complaint as quickly as possible. If the problem cannot be resolved during the trip period, you should contact us in writing within 14 days of returning from the trip.

 

15 - LAW & JURISDICTION

These terms and conditions and all matters arising therefrom are subject to Spanish Law and to the exclusive jurisdiction of the Spanish courts.
